Keir v. Unum Provident Corp., 2003 WL 2004422, 30 Employee Benefits Cas. 1598 (S.D.N.Y. April 29, 2003)
Quadrino Schwartz commenced the nation’s first disability insurance class action against UnumProvident Corp. and its subsidiaries, First Unum Life Insurance Company, Provident Life & Accident Insurance Company, Unum Life Insurance Company of America, and Paul Revere Life Insurance Company. The Unum Provident companies vigorously sought to have the entire case dismissed, claiming that a class action could not be maintained.
U.S. District Court Judge Denise Cote disagreed, and sustained all of the legal positions taken by Quadrino Schwartz on behalf of the thousands of potential class members throughout the United States. Each and every legal claim asserted by Quadrino Schwartz, on behalf of the potential class members, was fully sustained. Thus, the class action was ordered by the Court to move forward as a viable legal case.
