Insurance Company’s Decision to Deny Benefits Considered Arbitrary May 28, 2004
The carrier relied on the results of an exercise stress test to deny the claim. The claimant had submitted medical records from his treating cardiologist indicating that his blood pressure was elevated when working, and under control when he stopped working. The insurer failed to consider such evidence and relied solely on the information favorable to its determination.
