More States May Ban Discretionary Clauses in Disability Policies

Partner Richard Quadrino was tapped as a source for an article in Business Insurance magazine concerning industry trends concerning the use of discretionary clauses in group disability, health and life insurance policies.  The article, published on August 14th, notes that New York and Michigan are joining a number of other states in banning these clauses.  Quadrino Schwartz has been in the forefront of legal battles seeking to invalidate these unfair clauses so that disabled persons can get a fair shake in the legal system when the federal law ERISA is applied to a group insurance claim.
