UnumProvident Settles with State Regulators, Agreeing to Reconsider 215,000 Denied Disability Claims

UnumProvident has reached a settlement, as part of a multistate government investigation, to reconsider 215,000 denied disability claims. Quadrino Schwartz began the fight against UnumProvident in November, 2002 by filing the nation's first class action to assist thousands of disabled individuals across the U.S.

The government investigation was initially led by the Insurance Commissioners in Maine, Massachusetts and Tenessee. The U.S. Department of Labor later joined the effort, followed by New York's Attorney General, Elliot Spitzer. The agreement needs approval by 2/3 of the Insurance Commissioners in the U.S. to take effect.

If the deal moves forward, some people who had their claims denied or terminated may get a reconsideration of their claim. For claims denied or terminated after January 1, 2000 UnumProvident will send a leter to some of the people affected, offering them a process for a re-review of their claim. For those who had a claim denied or terminated after January 1, 1997 but before January 1, 2000, they can contact UnumProvident to make a request for a reconsideration. No notification will be made to people affected during that earlier time frame.
