Bad Faith Lawsuits

Several States, such as California, Arizona, Nevada, New Mexico, Montana, Pennsylvania, and Vermont have viable "bad faith" laws or legal precedent that will allow a claimant to sue in court for additional financial damages, such as punitive damages. Quadrino Schwartz prosecutes bad faith cases, along with local or co-counsel, in all States in which these damages can be sought.

In some States, a court can order that the disability insurer pay all of your future disability benefits in a lump sum, rather than waiting for each monthly payment. In addition, some States will allow a person who is successful in a bad faith lawsuit to recover his or her attorneys' fees from the disability insurer.

Each case must be carefully evaluated to determine whether a bad faith lawsuit can be brought. The attorneys at Quadrino Schwartz have decades of experience in the field and will consult and advise clients as to whether their case will qualify.
